Our Fees and Costed Services

Initial Consideration



Before deciding whether to instruct us and what to instruct us to do, many of our clients simply require an understanding of their legal situation, the extent of the risks or opportunities associated with that situation, whether we can help them and the potential costs of the help we propose. If you are a new client to us and we are your first port of call, we will usually agree to sort these preliminary issues out free of charge.

Costed Services (Fixed and Capped Fees)



We set out below fixed or capped fees for various categories of work. These are offered subject to the caveats at the end of this Web page.
  • Initial meeting with new employer client (you may choose the place) and basic audit of your current employment documentation and practices - £750 (excluding travel time);
  • Retainer for initial telephone advice concerning any employment related matter, (including monthly news bulletins, access to our fact sheets and one in house seminar per year) - based on the following scale (reviewable after the first year);

    0-10 employees £100 p.m.
    11-25 employees £200 p.m.
    26-50 employees £300 p.m.
    51-100 employees £400 p.m.
    101-500 employees £500 p.m.
    501 or more employees £600 p.m.

  • Review of existing standard document (e.g. contract of employment, statement of terms of conditions, statement of policy or procedure, up to 10 pages long) - £500.00;
  • Drafting/customising and/or advising upon new contract of employment and negotiating terms with new employee/employer or his/her legal representative on client's behalf (not including ancillary arrangements e.g. pension, share options etc) - time at hourly rates up to a cap - £750;
  • Drafting and negotiating compromise agreement and giving associated advice - time at hourly rates up to a cap - £1,000;
  • Prosecuting/defending Unfair Dismissal claim (from receipt of initial instructions to advocacy in Employment Tribunal or earlier settlement) - time at hourly rates up to a cap - £7,500 (excluding travel time);
  • Prosecuting/defending other Employment Tribunal claim (from receipt of initial instructions to advocacy in Employment Tribunal or earlier settlement) - time at hourly rates up to a cap - £10,000 (excluding travel time).

Given the nature and diversity of our work we cannot set fixed or capped fees for all scenarios. However, we would be delighted to agree a fixed or capped fee with you for each instruction received where sufficient detail and certainty is provided with the instruction to enable us to do so with a degree of accuracy and confidence.

Current Fee Rates



Where it is not possible to agree a fixed or capped fee, we will provide an advance estimate and we will charge for our work on the basis of the time which it takes to complete. The fee rates which we currently charge, for members of the Employment Team, are:

James BakerSolicitor£170 per hour.

Legal Expenses Insurance



In association with Vision Underwriting Limited we offer an insurance scheme which is designed specifically to cover the legal costs and the potential awards associated with Employment Tribunal claims.

We believe that this scheme has advantages over other legal expenses insurance policies and we would be delighted to obtain a premium indication if you are interested.

We only offer this scheme to clients who also use our audit and retainer services (referred to above).

Caveats


  • All the fees and fee rates referred to on this web page exclude VAT and disbursements, which will be charged in addition.
  • Michelmores will not be held to any fee or fee rate referred to on this web page unless it has entered into a written agreement with you to that effect. All such agreements will be subject to Michelmores' standard terms of business.
  • Michelmores reserves the right to alter its fees and fee rates at any time by agreement with clients.
  • The fixed and capped fees referred to above are intended to apply to routine matters falling within the relevant description of work. If your instructions are out of the ordinary we may seek to negotiate an alternative fixed or capped fee. Also, in the event of a matter becoming abnormally protracted and resource intensive so as to render the agreed fixed or capped fee uneconomic we will request that the extra time (based on the hourly rates referred to above) be allowed in addition to the fixed or capped fee.
  • Fees for abortive matters will be charged on a time basis (at the hourly rates referred to above) subject to a maximum of 100% of the relevant fixed or capped fee.
  • The Employment Team does not undertake work based on Community Legal Funding (Legal Aid), but occasionally we will undertake work on the basis of a "no win no fee" arrangement.
